The Hidden Edit is a queer art brand owned and operated in Australian. We specialise in selling fine art prints with the assistance of AI-generative technology and also traditional digital tools.

2. Orders and Payments

  • 2.1. Order Acceptance: All orders placed through our website are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspicion of fraudulent activity. An order confirmation email does not signify our final acceptance of your order, but is a confirmation that we have received it.

  • 2.2. Payment: We accept payment through Shopify Payments, which supports major credit cards and other payment methods. All payments are processed securely. Your order will not be processed until payment has been successfully received.

  • 2.3. Pricing and Currency: All prices are listed in Australian Dollars (AUD). Prices for international customers may vary depending on currency conversion rates applied by your bank or payment provider. Applicable taxes will be added at checkout where required. You are responsible for any customs duties, taxes, or fees that may be levied by your country for international orders.

  • 2.4. Order Modifications and Cancellations: Once an order is placed, it is immediately sent to our third-party print-on-demand partner for production. We cannot guarantee any modifications or cancellations to orders once they are submitted. Please review your order carefully before completing your purchase.

3. Products and Intellectual Property

  • 3.1. Product Descriptions: We strive to ensure our product descriptions and images are as accurate as possible. However, colors may vary slightly due to monitor settings and the nature of print-on-demand production. Minor variations in print size or framing may occur.

  • 3.2. AI-Generated Artwork: The artwork sold by The Hidden Edit is created using generative AI technology. This process is curated and directed by a human artist to create a specific emotional and aesthetic outcome. This disclosure is made to provide full transparency about our creative process.

  • 3.3. Intellectual Property Ownership: All artwork, imagery, text, and other content on this website are the exclusive property of The Hidden Edit and are protected by Australian and international copyright laws. This includes all AI-generated artwork. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the service, use of the service, or access to the service without express written permission from us.

  • 3.4. Limited Edition Prints: Where a product is designated as a "Limited Edition," this refers to a specific, finite series of prints. The numbering and availability details specified on the product page apply exclusively to that particular edition. While a given edition may sell out, we reserve the right, at our sole discretion, to release a new, separate edition of the same artwork at a later date. Any new edition would be clearly distinguished from previous runs.

4. Shipping and Delivery

  • 4.1. Shipping and Fulfilment: We use a third-party print-on-demand service, to fulfil all orders. This means your order is printed and shipped directly by them. Please refer to our separate Shipping and Delivery Policy for detailed information on processing times, shipping methods, and costs.

  • 4.2. Delivery Responsibility: Risk of loss and title for items purchased from The Hidden Edit pass to you upon our delivery to the carrier. We are not responsible for packages that are lost or stolen after the carrier confirms delivery. It is your responsibility to provide a safe and accurate delivery address.

  • 4.3. International Shipping: International orders may be subject to customs delays, import duties, and taxes imposed by the destination country. These fees are the responsibility of the customer. We are not responsible for delays caused by customs processing.

5. Returns and Refunds

  • 5.1. Policy: Our Refund and Returns Policy is detailed in a separate document. We do not accept returns for "change of mind." We offer refunds or replacements only for items that are defective or damaged upon arrival.

6. Limitation of Liability

  • 6.1. General: To the fullest extent permitted by law, The Hidden Edit shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our products or services.

  • 6.2. Australian Consumer Law: Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (ACL). Our goods and services come with guarantees that cannot be excluded under the ACL.

  • 7.1. Governing Law: These Terms and Conditions are governed by the laws of Australia. For Australian customers, any disputes will be resolved in accordance with Australian law.

  • 7.2. International Disputes: For international customers, while we will first attempt to resolve any dispute through good-faith communication, these Terms are ultimately governed by Australian law. However, your local consumer protection laws may also apply.

  • 7.3. Force Majeure: The Hidden Edit is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, or supply chain disruptions.
